Terms of Service

The agreement

Herbie Army ("we", "us") is a community project. We run Herbie Battleground, a game server for The Isle Evrima; the Herbie Army Discord server; a Discord bot that saves and restores dinosaur presets; and this website, herbiearmy.com. Together these are "the services".

By using any of the services you agree to these terms and to the community rules posted in our Discord server. If you do not agree, do not use the services. Our Privacy Policy explains what data the services collect.

Who may use the services

• You must be at least 13, or the minimum age at which Discord may be used in your country if that is higher.
• You must follow the terms of the platforms the services depend on: Discord's Terms of Service and Community Guidelines, the Steam Subscriber Agreement, and the licence terms of The Isle.
• You need your own Discord account, your own Steam account and your own copy of The Isle.

Linking your Steam account

• Link only a Steam account that belongs to you.
• A Discord account can be linked to one Steam account at a time, and a Steam account to one Discord account.
• Sign-in links from the bot are for you alone. Do not pass them to anyone else.
• You are responsible for what is done through your linked accounts. Keep them secure.
• Staff may remove or correct a link that is wrong, disputed or misused.

Presets

A preset is a saved record of one of your dinosaurs: its species, growth, mutations and prime status. Loading a preset changes the dinosaur you are playing to match it.

• Presets are a convenience and come with no guarantee. A game update, a change to the server or a fault can make a preset unusable, or lose it.
• Loading a preset replaces the current state of the dinosaur you are playing. The bot asks you to confirm first; after that the change cannot be undone by us.
• Staff may pause loading, limit how presets are used, or remove presets, in order to keep the server fair or working.
• Presets have no monetary value. They are tied to your accounts and may not be sold, traded or transferred.

In-game admin rights

Where the community gives members admin rights on the game server through the bot, those rights are a privilege, not an entitlement.

• Use them only as the community rules allow.
• What you do with them is logged by the game server and by the bot.
• We may limit or remove them at any time, for any member or for everyone.

What you must not do

• Link, or try to link, a Steam account that is not yours, or pretend to be another member or a member of staff.
• Try to read, change or delete another member's link or presets.
• Exploit a bug in the bot, the mod or the game to gain an advantage, or to do something the bot would otherwise refuse. If you find a bug, report it to staff.
• Flood the bot with commands, automate its use, or otherwise try to overload or disrupt the bot, the game server or this website.
• Probe, attack or try to get around the security of the services.
• Use the services to harass anyone, or for anything unlawful.

Enforcement

If you break these terms or the community rules, staff may warn you, remove your presets or your account link, take away in-game admin rights, or remove you from the Discord server and the game server, for a time or for good. Staff decide what is fair in the circumstances. If you think a decision was wrong, raise it with staff in the Discord server.

Availability

The services are a community project. We may change, pause or stop any part of them at any time, with or without notice. The game server restarts from time to time, and the bot may be unavailable while the game server is down or being updated.

Other companies

Herbie Army is not affiliated with, endorsed by or sponsored by Afterthought LLC, Discord Inc. or Valve Corporation. The Isle, Discord and Steam are trademarks of their owners. Your use of those products is governed by their own terms, and we are not responsible for them.

No warranty

The services are provided "as is" and "as available". To the fullest extent the law allows, we make no promises about them, whether express or implied, including that they will be uninterrupted, free of errors, secure, or fit for a particular purpose, or that presets and other game data will be preserved.

Limit of liability

To the fullest extent the law allows, Herbie Army, its staff and its volunteers are not liable for any indirect, incidental or consequential loss arising from your use of the services, nor for the loss of presets, game progress, characters or other in-game data. Where liability cannot be excluded, it is limited to the amount, if any, that you paid us to use the services.

Nothing in these terms removes rights that the law of your country gives you as a consumer and that cannot be signed away.

Changes and ending

We may change these terms. When we do, we will update the date at the top of the page and announce any change that matters in our Discord server. If you keep using the services after a change, you accept the new terms.

You may stop using the services at any time, and you can ask us to delete your data as the Privacy Policy describes. We may end your access as set out under Enforcement.
